For ease of reference the parties will jointly be referred to as “the Mall Operators” / “we” / “us” / “Best Braais” / “Best Braais cc” or directly specified. All affiliates (suppliers and service providers) provide their services to you subject to the conditions detailed in this agreement. By using the bestbraais.co.za website and/or registering to shop on bestbraais.co.za, you confirm that you have familiarized yourself with the terms and conditions governing the conduct of parties accessing or using the bestbraais.co.za website to trade and that you agree to be bound by these terms and conditions.

THE LIABILITY OF THE MALL OPERATORS THEIR DIRECTORS, EMPLOYEES, OFFICERS, SUPPLIERS, AND SERVICE PROVIDERS TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO R500.00.
Applicable law
The bestbraais.co.za website and all communications and transactions concluded using the website, are governed by, and you agree to, the application of the laws of the Republic of South Africa. As the website is targeted at South African citizens and residents any limitations on implied warranties or the exclusion or limitation of certain damages which may be applicable under the laws of any other jurisdiction are expressly waived by you, and to the extent that they cannot be waived, you shall not enter into any transactions with bestbraais.co.za
TERMS OF TRADE WITH BESTBRAAIS.CO.ZA
Invitation to do business
The products or services which appear on the bestbraais.co.za website are displayed as an invitation to do business and to allow you to make an offer to purchase the products or services to bestbraais.co.za. Once you tick the box labelled “I accept“, these Terms and Conditions of Sale is accepted by you unconditionally. Only when the Mall Operators have communicated acceptance of your offer and capability to fulfill the order will an enforceable agreement of sale be transacted. This communication of acceptance from the Mall Operators can only be communicated to you once we have confirmed stock and pricing from our suppliers.
The price of any products or services sold through bestbraais.co.za shall be confirmed on the acceptance of your order. Despite our best efforts, a small number of the products or services offered on the website may be mispriced.
• If the correct price is lower than our stated price, we will charge the lower amount provided that the price difference is not too high.
• If the correct price is higher than our stated price, we will be entitled to adjust the price to reflect the correct value.
IMPORTANT: If any products or services are supplied and delivered to you directly by, or through, a third party, even though access to the products and services is gained through the bestbraais.co.za website, the supply of these products and services may be subject to conditions which differ from those governing the terms of trade with bestbraais.co.za. You shall be solely responsible for ensuring that you understand and agree to the terms and conditions governing the sale of these products and services.
Place and time of agreement
Agreement as to the terms of use of the bestbraais.co.za website shall be deemed to have be accepted by you at the time that you first accessed the bestbraais.co.za website and thereafter confirmed each time that you access the bestbraais.co.za website.
Agreement to use the bestbraais.co.za website and those governing all transactions that may be effected using the bestbraais.co.za website shall be deemed to have taken place in Cape Town.

If only part of an order leaves our premises, only that portion of the order is deemed as accepted. bestbraais.co.za can cancel any order at any time. Orders will not be kept for longer than 3 weeks.

Backorders
Due to the popularity of some products or services, the Mall Operators may not always have a products or services ordered by you in stock. Mall Operators will accept orders for out of stock products or services to ensure that you will be able to receive the item once it becomes available. If the products and services ordered by you are not available or only a portion is available, you may cancel the order, or re-order the quantity that is available, or place a backorder. Once the products or services become available, it will be shipped to you. Backorders will not be kept for over 3 weeks.
Electronic communications
When you visit bestbraais.co.za or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. The Mall Operators will communicate with you by e-mail or by posting notices on the bestbraais.co.za website. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Further, that your acceptance of any terms or conditions applicable to the bestbraais.co.za and transactions concluded using the bestbraais.co.za website, as well as your intent to enter into any transaction on bestbraais.co.za, may be evidenced by any action by you from which this may reasonably be inferred.
Registration

Password

AMENDMENT TO TERMS AND CONDITIONS
The Mall Operators reserves the right to change, modify, add to or remove portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes posted to this website. It is the User’s obligation to periodically check these Terms and Conditions at the website for changes or updates. The User’s continued use of this website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
Advertising and Printed Material

Best Braais cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device. By placing an order with Best Braais cc; either verbally,  by telephone, e-mail or via the Best Braais website you expressly and unequivocally agree that Best Braais may share your contact details and address to the relevant third parties  in order to effect the transactions agreed to.

Copyright in any information or trademarks displayed anywhere on the bestbraais.co.za website are protected by worldwide copyright laws and treaty provisions. The copyright of these materials is held by the Mall Operators or by the original creator of the materials, or by suppliers and service providers to the bestbraais.co.za website. None of the materials may be copied, reproduced, modified, published, uploaded, posted, transmitted, or distributed in any form or by any means other than as described on the bestbraais.co.za website or with the prior written permission of the Mall Operators. All rights not expressly granted herein are reserved. Any unauthorized use of the materials appearing on the bestbraais.co.za website may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.

Credit Disclaimer – Mobicred Instalments

  1. Any monthly instalment amounts displayed on the bestbraais.co.za website are for illustrative purposes only. Such amounts are calculated using the Mobicred instalment widget, which provides an estimate of what the monthly repayment may be if a product were purchased through Mobicred and repaid over a period of twelve (12) months.

  2. The displayed instalment values are approximate and may not reflect the final terms offered by Mobicred. Buyers are advised to contact Mobicred (the credit provider) directly for detailed, accurate, and up-to-date information regarding credit terms, interest rates, and repayment obligations.

  3. Best Braais CC is not a financial services provider, does not offer credit directly, and is not affiliated with any credit institutions. Any credit agreements entered into by a buyer with Mobicred (or any other credit provider) are entirely separate from the purchase of products on the bestbraais.co.za website.

  4. In the event of a dispute or query relating to a Mobicred credit agreement, the buyer acknowledges that Best Braais CC cannot be held liable or accountable. All such matters must be resolved directly between the buyer and Mobicred (the credit provider).

  5. By proceeding with a purchase, the buyer accepts without reservation that:

    • Any instalment amounts displayed on the website are estimates only and not a binding offer of credit.

    • Best Braais CC’s responsibility is limited solely to the sale and delivery of products.

    • All credit arrangements, obligations, approvals, and disputes fall exclusively under the jurisdiction of the credit provider.

    • Best Braais CC reserves the right to update, remove, or amend any displayed credit estimation information at any time without notice.

    • The use of the Mobicred widget is at the buyer’s discretion, and Best Braais CC makes no warranties regarding the accuracy of the information displayed.

DISPUTE RESOLUTION
Any dispute arising out of or in connection with this agreement including any question regarding its existence, validity or termination, shall be settled by the online dispute resolution process in accordance with the TrustEnforce.org Mediation and Arbitration rules, which rules are deemed to be incorporated by reference into this clause and may be accessed at www.trustenforce.org.
For all disputes regardless of where they arise, the place of the arbitration is deemed to be Cape Town. The arbitration will be governed by this clause governing arbitration and the arbitration laws of South Africa. The dispute will be resolved in accordance with the law of South Africa. The language used during the dispute resolution process will be English.
For the purposes of any arbitration and service of any legal documentation:
You choose the email address elected by you to receive delivery of the products and bestbraais.co.za chooses [email protected].
By using the bestbraais.co.za website and accepting the conditions of use of the website and trade conducted using the website you bind yourself to the terms of arbitration provided in this agreement.

Return of products or cancellation of service agreements
Broken or otherwise damaged products must be reported to Best Braais within one day of receiving the products, this must also be indicated on the delivery note / waybill at the time of delivery. We will require photos showing the damage (within one business day). It is advisable not to install or use the goods until such time that you have finished your correspondence with Best Braais cc and finalized an arrangement.  Best Braais will then arrange for replacement parts / products to be delivered to you. Refunds may be paid upon request from the customer for broken / damaged products. If damage is only reported after one day of receiving the the product, it is reasonable for the seller to determine that the damage was caused post-delivery. Damage or missing items reported only after the driver has left and the waybill has been signed is not covered by our insurance. Should the customer choose to collect their order from the factory or courier depot , it is important to check the contents of the shipment to make sure that the right items have been received, everything is included and that the items have suffered no damage. If damage is reported after signing and collecting from the factory or courier depot, it is reasonable for the seller to determine that the damage was caused post-collecting. Damage or missing items reported only after you have removed the product from the  factory or courier depot and the collection note or waybill has been signed is not covered by our insurance.  Please note that all guarantees /warranties is held by the respective manufactures and not by Best Braais cc. Please note that the following issues/problems will not render the product damaged, defective or unsuitable as aforesaid and will not entitle you to any repair, replacement or refund:

  • faults resulting from normal wear and tear;
  • damage arising from negligence, user abuse or incorrect usage of the product;
  • damage arising from sea air corrosion;
  • damage arising from a failure to care for the product adequately;
  • damage resulting from wrong installation/water leakage onto / into the product
  • damage resulting from unauthorized alterations to the product;
  • where the specifications of a product, although accurately described on the Website or Quotation and generally fit for its intended purpose, do not suit you.

Wrong Items Ordered:
Orders may be returned within 7 working days for a refund if:
The item is returned within 7 days from its date of delivery, Your original Best Braais invoice (receipt) is produced with the returned item , Best Braais will not accept a bank statement as proof of purchase. Products returned must be unopened, unused and in its original condition and packaging, If you are not able to comply with these conditions, Best Braais reserves the right to refuse an exchange or refund on wrong / change-of-Items ordered returns. Returns will be processed at the customer’s own expense (including courier delivery) and may be rejected if the product has been opened or damaged after initial delivery; all returned products will be thoroughly inspected before the return is accepted by Best Braais to ensure full compliance with the above stated terms by the customer. Products that were used or damaged after delivery will NOT be refunded.  Products returned must be unopened, in its original condition and packaging. We will refund all returned / cancelled orders after the deduction of an R400 minimum handling fee. Best Braais cc reserve the right to charge a  admin fee between 10 and 15%, Note: any banking fees  applicable during the refund possess  will be for the customer’s account.

If the incorrect product has been delivered to the customer, the customer must contact Best Braais within one business day to arrange for the delivery to be corrected. The exchange will not be processed if the customer has used, installed or damaged the incorrectly delivered item. If you return a product to us, but you fail to include all of the accessories and parts sold with that product, we are entitled to (subject to applicable law) refuse the return. We may decide only to replace the item/s that you did return or to estimate the value of the missing accessories and parts and only to credit or refund you in respect of the returned item/s.

Exclusions from return of products or cancellation of service agreements.
The provisions of this agreement relating to the return of goods and cancellation of any agreement to provide services shall not apply to:
Custom / Special Order Products:
• Where the products are personalized or made to the customer’s specifications;
(note; any product that you order from Best Braais cc which does not expressly appear on the bestbraais.co.za website is deemed an custom item /special order)
Once manufacturing of your custom or special order has started, no returns or refunds on any deposits paid can be granted. As this product is made to order, the raw material is purchased when you confirm your custom or special order, this material is then used for your order, therefore no exchanges and refunds are permissible and as such this is deemed a non-qualifying item. Any Measurements supplied by you, your contractor or any party acting on your behalf for the manufacturing of a custom size product will be used as the final size measurements you would like the product to be manufactured to for your existing brick braai / fireplace. Measurements supplied by you will be deemed correct by Best Braais cc. Best Braais cc will not be held responsible for any measurements incorrectly supplied by you, your contractor or any party acting on your behalf for the manufacturing of custom size products.

• Bulk Orders; where you have ordered a large Quantity of a specific product and the products is generally fit for its intended purpose.
• Where the products by reason of their nature cannot be returned.

Outstanding Payments and Custom Orders Clause

For all custom-sized or special-order products, once the order has been completed and the customer has been notified via email that the order is ready, dispatch or delivery will not take place until all outstanding payments have been fully settled and are reflecting in Best Braais CC’s bank account.

If the outstanding balance remains unpaid for more than thirty (30) days from the date of initial notification, the customer expressly agrees and acknowledges that Best Braais CC reserves the right to sell or otherwise dispose of the product in order to recover the outstanding amount due. Any proceeds from such sale will be applied toward the customer’s balance, and any shortfall shall remain payable by the customer.

bestbraais.co.za obligations on return of the products and services
Within thirty days of return of the products or receipt of notice of cancellation of the agreement to deliver services, the Mall Operators or their authorized agents shall refund to the customer any amounts paid by the customer less any amounts due by the customer to the Mall Operators as provided for above. Please note that the Consumer Protection Act (CPA) protects both the consumer and the supplier during the purchase of our goods. Under the act, your option to return purchased goods is waived once the goods have been installed at your property. Specially manufactured/ ordered and sprayed items or any Bends or flues (pipes) are non-refundable, so please ensure you are happy with your product selection before placing your order.

Description of Services: bestbraais.co.za provides access to a variety of products and services that may be purchased online all of which are, or will be, described on the bestbraais.co.za website.
Price of goods: Prices are displayed in the website and are subject to bestbraais.co.za rights in respect of any miss pricing stipulated in the clause dealing with Invitation to do business above.
Payment: Payment terms and manner of payment are stipulated in the clause dealing with payment above.
Terms and conditions governing this agreement: The full Terms and Conditions applicable to the access and use of the services provided on the bestbraais.co.za website and any amendments thereto, shall at all times be available on the Website, save to the extent that they may be varied in writing by the parties. These terms may be accessed on this Website, downloaded and stored, or reproduced at any time.

Delivery of products or services:
Orders will not be processed if payment has not been received from the customer.
We offer free delivery on Braai and Fireplace units to all main centres in South Africa.
Some major towns also qualify for free delivery and will be indicated during checkout. Free delivery will only apply to Best Braai brand Products bought at the regular price. Replacement parts, accessories or flues & cowls ordered individually may not qualify for free delivery. Notwithstanding any indication of free delivery or  shipping fees on our website, such offers shall only apply to products sold at their original full price. In the event of a sale, promotion, or discount, the free delivery or reduced shipping fee offer shall be null and void, and standard shipping fees shall apply. The anticipated time of delivery of any products or services, purchase using the bestbraais.co.za website shall be indicated at the time that any order is accepted by bestbraais.co.za. A separate delivery fee (“Delivery / Shipping Fee”) may be charged in addition to the price you pay for the goods that you purchase. Delivery periods are only regarded as having commenced once payment reflects in the Best Braais bank account. Bank Transfer into our bank account; Our Banking details will be provided after checkout. Payment for such orders must be made within 5 (five) days of placing your order. Best Braais will not accept any orders placed whether online, telephonic or via email if payment has not been received. In the event that a deposit is paid, goods will only be dispatched once the full balance amount due reflects in the Best Braais bank account. All goods remain the property of Best Braais cc until paid in full. If Best Braais regards the transaction to be large and/or unusual, Best Braais may carry out certain fraud checks with the cardholder’s bank and the delivery period shall only be regarded as having commenced upon completion of such checks. Lead periods are calculated based on business days only. Saturdays, Sundays and public holidays are not taken into account in calculating Lead periods.  Delivery periods will be subject to a lead time of +/-15 (fifteen) working days (Please note during SALE periods, orders can take up to 20 working days) to completion and a time of +/-3 (three) to 5(five) working days for road freight – (if applicable). For custom size products or 316 grade Stainless steel products lead times may escalate up to 30 (thirty) business days for completion of orders. For Regional & Outlaying Towns that seldom have couriers delivering there, the delivery time may escalate. Kindly note; during times of Load Shedding, Labor Strikes or Pandemic Restrictions lead times may increase. NB; It is worth noting that if your project are subjected to a deadline, it is recommended that you place your order timeously to avoid disappointment. Best Braais cc will not be held responsible for your project’s deadline in any way. If products with different delivery times are ordered together, the product with the longest delivery time will determine the delivery time of all the products in the order. So, if you want to order various products where some have a shorter delivery period than others Best Braais recommends that you order such products separately from the products requiring longer delivery times. Where delays occur, every reasonable effort will be made to inform the Purchaser. Best Braais under takes to deliver our products to you as mentioned above. Due to the size and weight of these products we undertake to deliver it to your premises at curbside only  – normal access assumed. “Curbside” means next to the curb on the street, this will also apply for any collections. Under no circumstances will any of the Best Braais delivery staff or courier delivery staff be obligated to carry any braais or fireplaces upstairs or load it into a elevator. Best braais will not except any liability due to damage to property or injury to self or damage to the product by attempting to carry our products upstairs or loading it in a elevator. Should the driver agree to assist the customer to move the product, this will be deemed as a private agreement between the driver and the customer from which Best Braais will not except any liability. Should the customer refuse delivery as result of curbside delivery, the customer will be responsible for all initial shipping and re-delivery charges. Should the customer choose to collect their order from the factory or courier depot , it is important to check the contents of the shipment to make sure that the right items have been received, everything is included and that the items have suffered no damage. If damage is reported after signing and collecting from the factory or courier depot, it is reasonable for the seller to determine that the damage was caused post-collecting. In the event that the customer elects to have their order delivered to a third-party courier or freight forwarding agent, it shall be the responsibility of the receiving third party to inspect the goods for any potential damage upon receipt. The mere act of marking the waybill or delivery note as ‘not checked’ shall not, in itself, exempt the customer from liability in cases where the goods sustain damage while in the custody of the third-party forwarding agent.  By placing your order with Best Braais whether online, via email or telephonic, you unconditionally agree to these terms. We strongly recommend that the product be moved by your contractor/installer and  staff in a safe and responsible manner.

Orders are subject to a lead time of +/-15 (fifteen) working days to completion (excludes Transit time).
Estimated Transit time from date of sailing 20 – 54 days.

INTERNATIONAL SHIPPING DEPOSITS
International shipping Deposits are paid on placement of your order for shipping to another country. Shipping deposits indicated during checkout is an estimated deposit only and Final cost are thus levied on rates prevailing at the time of shipment and also final crated volume. Final cost will thus be made available to you once the your order have been delivered to the forwarding agent and wrapping and crating have been completed.

FOB & Shipping Cost Includes:
– Protective export packing/wrapping & crating
– Export customs clearance; handling & documentation formalities
– Ocean freight: Cape Town – Destination Depot/Ports
– Export cargo dues
FOB & Shipping Cost Excludes:
– Collecting goods from destination Depot/Port & delivery to your premises.
– Insurance : All Risk (cost & freight) (an excess applies in the event of a claim)
– Destination customs clearance; terminal handling charge; documentation and delivery to residence
(delivery will be depot to Depot/Port only – normal access assumed)
– Any destination duties; taxes; customs inspections; demurrage; deposits; quarantine related charges; etc. that may be incurred or required
– Delivery beyond normal access
– Any extraneous charges not associated with a normal clearance or delivery at destination Port/Depot
– The use of any special lift equipment
– Any additional Handling; packing; wrapping; shipping; etc without prior notification
– Destination storage if required / incurred
– Local pre-shipment storage for cargo not dispatched within 3 weeks of first receipt of cargo at a rate of R150,00/cubic meter per week with a minimum charge of R150,00 / week

Kindly note that international shipping costs are based on current shipping, destination and
exchange rates. Final cost are thus levied on rates prevailing at the time of shipment and also
final crated volume. Our freight forwarders may contact you should rates differ vastly at time of sailing.

Installation of Products:
Best Braais cc is in no way shape or form affiliated to any contractors or installers, we recommend that a reputable builder / installer is employed to assist you with the installation of your product.
All Built in Braai and Fireplace units displayed on the Best Braais website is intended for indoor installation. (All Built in Braai and Fireplace units should enjoy positive protection from wind rain and sun.)
Best Braais will in no way be held accountable for any damage to the product, your self or others that may occur as result of installing any of our products in an outdoor environment.

Dispute resolution: The provisions governing Dispute Resolution are stipulated under the clause Dispute Resolution above.
Privacy and Security: The provisions governing Privacy and Security are provided for under the clause Privacy and Security above.
Minimum duration of Agreement: There shall be no minimum duration of agreements entered into between users and registered purchasers to use the bestbraais.co.za website. All agreements shall endure indefinitely subject to either parties rights to terminate the agreement. The termination of the agreement by either party shall be without prejudice to any rights between the parties existing at the time of the termination, which shall endure beyond the date of termination
Any provision in these terms and conditions which is or may become illegal, invalid or unenforceable in any jurisdiction affected by these terms and conditions shall, as to such jurisdiction, be ineffective to the extent of such prohibition or unenforceability and shall be treated pro non scripto and severed from the balance of these terms and conditions, without invalidating the remaining provisions of these terms and conditions or affecting the validity or enforceability of such provision in any other jurisdiction.
Errors:
Please note that although bestbraais.co.za endeavours to accurately describe and/or depict each product on the Website, some descriptions or photographs may be of a generic nature and not specific to the particular product you wish to buy. However, should you be dissatisfied with the product you receive due to damage or wrong item delivered, you are entitled to return the product to bestbraais.co.za for a full refund within ten days of delivery with original sales receipt. Please see our Refund Policy above in this regard (which explains how and when you can be refunded, as well as how returns are to be made).
Errors and Omissions:
